Terms of Service

01 About This Agreement

These Terms of Service govern the use of PingLoop, a WhatsApp business messaging platform provided by Lynx Tech ("we," "us," "our"). By using PingLoop, a business ("Client," "you") agrees to these terms.

02 The Service

PingLoop enables a Client to send and receive WhatsApp messages, manage conversations, and configure automated messaging workflows, including integrations with third-party platforms such as Shopify where enabled. Lynx Tech acts as a technology provider on the WhatsApp Business Platform, operating on behalf of the Client — the Client remains solely responsible for their own communications, products, and compliance with applicable law in how they use the service.

03 Client Responsibilities

The Client agrees to:

• Only message individuals who have consented to receive WhatsApp communications from them
• Comply with WhatsApp's Business Policy, Commerce Policy, and all applicable data protection and consumer protection laws
• Maintain the confidentiality of their account credentials
• Ensure any automated workflows they configure are accurate and do not mislead their customers

04 Acceptable Use

The Client will not use PingLoop to send unsolicited messages, spam, or content that is illegal, deceptive, or violates WhatsApp's own policies. Lynx Tech reserves the right to suspend access for any account found in violation.

05 Data and Privacy

Use of PingLoop is also governed by our Privacy Policy, which describes how information is collected, used, and protected.

06 Service Availability

We work to maintain reliable service but do not guarantee uninterrupted availability. Scheduled maintenance and factors outside our control (including WhatsApp Business Platform availability itself) may affect service at times.

08 Limitation of Liability

To the maximum extent permitted by law, Lynx Tech is not liable for indirect, incidental, or consequential damages arising from use of the service. Our total liability for any claim is limited to the fees paid by the Client in the preceding billing cycle.

09 Termination

Either party may terminate service with written notice, effective at the end of the then-current billing cycle. Lynx Tech may suspend or terminate access immediately for a violation of these terms or WhatsApp's own policies.

10 Changes to These Terms

We may update these terms from time to time. Continued use of PingLoop after changes take effect constitutes acceptance of the updated terms.

11 Governing Law

These Terms are governed by [APPLICABLE LOCAL CYBER LAW AND JURISDICTION — TO BE SPECIFIED] and the relevant policies of the WhatsApp Business Platform.
